General Terms and Conditions

§ 1 Scope

These General Terms and Conditions apply to contracts between WTF Studio Frankfurt – Wild Tattoo Fantasy (hereinafter the “Studio”) and its customers for the services offered by the Studio, in particular tattoos, piercings, tooth jewellery, consultations and related services.

Individual agreements with the customer take precedence over these Terms and Conditions. The applicable Terms and Conditions will be made available to the customer before the contract is concluded.

§ 2 Booking Appointments

An appointment becomes binding once it has been confirmed by the Studio and, if a deposit is required for the appointment, the agreed deposit has been received.

Appointments may be booked in person, by telephone, via the website, Instagram, WhatsApp or other communication channels offered by the Studio.

The customer must provide accurate and complete information when booking and notify the Studio promptly of any changes to their contact details.

§ 3 Deposits

The Studio may require a deposit to secure an appointment. The specific amount of the deposit will be communicated to the customer before booking.

The deposit will be credited in full towards the agreed price when the agreed appointment is duly carried out.

If the customer cancels the agreed appointment at least 14 days before the appointment, the deposit paid will, at the customer’s choice, be refunded or transferred to a new appointment.

In the event of a cancellation less than 14 days before the agreed appointment or a failure to attend, the deposit may be offset against any actual, legally recoverable loss incurred by the Studio as a result. If the reserved time slot can be allocated to someone else or the Studio saves expenses, this will be taken into account when calculating the loss.

§ 4 Cancelling and Rescheduling Appointments

If a customer is unable to attend an appointment, they must inform the Studio as early as possible.

An appointment may be rescheduled by agreement with the Studio. There is no entitlement to a particular replacement appointment.

Very short-notice cancellations or failures to attend can result in substantial unused working time, particularly for longer tattoo appointments. Any claims by the Studio are governed by statutory provisions and the loss actually incurred or legally recoverable.

Any goodwill concession made by the Studio in an individual case does not create an entitlement to similar treatment for future appointments.

§ 5 Late Arrival

The customer must arrive on time for the agreed appointment. If the customer is significantly late, the available working time may be reduced accordingly.

If it is no longer possible to carry out the service professionally and safely within the remaining time, the appointment may be rescheduled or discontinued. Whether any costs arise, and their amount, will depend on the circumstances of the individual case and the applicable statutory provisions.

§ 6 Prices and Scope of Services

The agreed price depends in particular on the design, size, body location, level of detail, work involved and estimated duration.

An agreed price applies to the previously defined scope of services. If, after the price has been agreed, the customer requests substantial changes to the design, size, body location, style, level of detail or scope, a new price calculation may be necessary. The new price will be communicated to the customer before the additional or modified service is carried out.

For projects involving several sessions, each session will be charged in accordance with the individual agreement.

§ 7 Full-Day Sessions

For a service offered as a “full-day session”, the duration, price and scope of services expressly agreed at the time of booking apply.

Where agreed, session time may include not only the actual tattooing but also necessary work such as adapting the design, positioning, preparation, and creating or applying the stencil.

Necessary breaks taken by the artist, totalling up to 60 minutes, may form part of an agreed full-day session.

A full-day session does not automatically mean that any desired tattoo can be fully completed within one day. The actual work involved depends in particular on the design, size, skin, body location, level of detail and the customer’s individual ability to tolerate the session.

If a further session is required, it will be agreed separately with the customer and charged separately, unless expressly agreed otherwise.

§ 8 Promotions, Discounts and Special Offers

Promotions and special prices apply only for the stated period and scope of services. Discounts and promotions cannot be combined unless the Studio expressly confirms otherwise.

Individually agreed special terms may be documented in writing or in the relevant appointment or consent form.

§ 9 Customer Health

Before the procedure, the customer must truthfully inform the Studio of any circumstances that may be relevant to carrying it out safely. These may include, in particular, allergies, skin conditions, impaired wound healing, relevant pre-existing medical conditions, pregnancy and the use of relevant medication.

The Studio does not provide medical diagnoses or instruct customers to stop taking medication prescribed by a doctor on their own initiative.

If there are concerns about the customer’s health, the Studio may recommend a medical assessment before proceeding, or refuse or postpone the treatment until such an assessment has taken place.

§ 10 Alcohol, Drugs and Impairment

The Studio will not carry out a tattoo or piercing if the customer is visibly under the substantial influence of alcohol, drugs or other intoxicating substances, or is otherwise unable to give valid consent.

The Studio may also refuse to carry out the procedure if, in its professional judgement, safe treatment cannot be ensured.

§ 11 Design, Stencil, Spelling and Position

Before tattooing begins, the customer will have an opportunity to check the design and intended placement.

The customer must carefully check, in particular, the design, spelling, names, letters, numbers, dates, symbols, size, orientation and exact position on the body.

Any changes or visible errors must be communicated before tattooing begins. By giving their express approval, the customer confirms that the version shown to them is as they wish.

§ 12 Piercing Position and Jewellery

Before a piercing is carried out, the intended body location or position will be agreed with the customer. The customer will have an opportunity to check the intended position and communicate any requested changes before the procedure.

The type of piercing, body location and, where necessary, jewellery or material will be documented.

§ 13 Refusal of a Service

The Studio and the artist carrying out the work may refuse a tattoo, piercing or other service on objective, health, technical, legal or ethical grounds.

This applies in particular where safe performance cannot be ensured; the skin or body location appears unsuitable at the time; the design or desired size is unlikely to allow a professionally acceptable result; an unchanged copy of another person’s copyright-protected work or tattoo is requested; required consent or proof of age is missing; the customer is visibly unable to give valid consent; or the artist considers that they cannot responsibly carry out the design or requested procedure.

§ 14 Custom Tattoo Designs

Custom designs created by the Studio or artist are prepared for the agreed tattoo.

Payment for a tattoo does not automatically transfer to the customer all copyright, exploitation rights or other rights of use in a custom design.

The customer is entitled to receive an editable or high-resolution digital design file only if this has been expressly agreed. The customer’s statutory rights remain unaffected.

§ 15 Healing Process

Tattoos and piercings involve intervention in the skin or tissue. Even when carried out professionally and hygienically, individual reactions and complications cannot be completely ruled out.

The healing process depends, among other things, on skin characteristics, body location, individual wound healing, aftercare, physical exertion and other personal factors. The Studio therefore cannot guarantee a particular individual healing outcome.

Statutory rights relating to a defective service for which the Studio is responsible remain unaffected.

§ 16 Aftercare Responsibilities

The customer will receive aftercare and behavioural instructions and is responsible for following them carefully.

Improper aftercare, heavy scratching, unnecessary friction, intense sun exposure, bathing, swimming pools, saunas or other factors that interfere with healing can adversely affect the result.

In the event of unusual, severe or worsening symptoms, the customer should seek medical advice. The Studio is not a substitute for medical diagnosis or treatment.

§ 17 Touch-Ups

Where a free touch-up has been expressly promised for a tattoo, it will be carried out in accordance with the conditions agreed with the customer for that purpose.

In particular, this requires that the tattoo has been cared for in accordance with the aftercare instructions and that a touch-up is professionally appropriate.

A free touch-up may be excluded if the change was caused in particular by improper aftercare, tampering, injuries, excessive sun exposure, procedures performed by third parties or other circumstances for which the Studio is not responsible.

Statutory rights in respect of defects remain unaffected.

§ 18 Cover-Ups, Scars and Existing Tattoos

For cover-ups, scar coverage and tattoos on skin that has already been altered or tattooed, the achievable result depends particularly strongly on the initial condition.

Digital designs or simulations are used for visualisation and do not guarantee that the result on actual skin will look exactly the same.

The Studio may recommend changes to size, contrast, composition or placement where these appear necessary for professional execution.

§ 19 Clothing and Personal Belongings

During tattooing and piercing, tattoo ink, disinfectants, care products or other working materials may come into contact with clothing or personal belongings despite careful working practices.

Customers are therefore advised to wear suitable clothing that is as resistant to damage or staining as possible. The Studio is liable for damage in accordance with statutory provisions and the liability provisions of these Terms and Conditions.

§ 20 Photographs and Video Recordings

Photographs or videos in which a customer is identifiable will be used for advertising, portfolio or social media purposes only where the required consent has been obtained.

Consent to advertising photographs or recordings is voluntary and is not a condition for carrying out the booked tattoo or piercing service. Separate consent will be obtained where required.

§ 21 Minors

The Studio’s internal rule for tattoos is that no tattoos will be carried out on anyone under the age of 16.

For persons under the age of 18, the personal presence and consent of a parent or legal guardian with parental responsibility are required. Tattoos on the face, neck, hands or intimate areas will not be carried out on minors.

Piercings are subject to the age and consent rules set out in the piercing consent form.

The Studio may refuse a service for a minor, regardless of consent, if it considers, in its professional judgement, that the service cannot responsibly be carried out.

§ 22 Consent and Risk Disclosure Forms

Before tattoos and piercings, the customer may be required to complete and sign a separate consent and risk disclosure form in full.

This serves in particular to document health information, information provided about risks, consent and approval.

§ 23 Discontinuing Treatment

The Studio or artist may interrupt or discontinue treatment in progress if continuing safely or professionally is no longer possible or reasonable.

This applies in particular in the event of significant adverse health reactions, inability to cooperate, aggressive behaviour, sexual harassment, threats or other conduct that endangers staff, artists or other persons.

Payment for services already duly performed and any further claims are governed by statutory provisions.

§ 24 Conduct in the Studio and Control of the Premises

Respectful conduct towards staff, artists and other customers is required in the Studio.

Insults, threats, violence, sexual harassment, discriminatory behaviour and serious disruption will not be tolerated.

In such cases, the Studio may exercise its right to control access to its premises, require persons to leave and refuse future appointments.

§ 25 Gift Vouchers

Gift vouchers are subject to the terms stated at the time of purchase and the applicable statutory provisions.

As a general rule, the value of a gift voucher will not be paid out in cash unless otherwise required by law.

Unless another valid provision applies, the limitation period for claims arising from gift vouchers is governed by statutory provisions.

§ 26 Liability

The Studio is liable without limitation for damage arising from injury to life, body or health insofar as it results from an intentional or negligent breach of duty by the Studio, its legal representatives or persons engaged to perform its obligations.

For other damage, the Studio is liable without limitation in cases of intent or gross negligence.

In the event of a slightly negligent breach of essential contractual obligations, liability is governed by statutory provisions; to the extent permitted by law, liability is limited to damage that is typical of the contract and foreseeable.

Liability for consequences resulting exclusively from information that the customer has demonstrably provided falsely or withheld, or from a failure to follow aftercare instructions for which the customer is responsible, exists only in accordance with statutory provisions.

Mandatory statutory claims for liability remain unaffected.

§ 27 Reviews and Public Statements

The customer’s right to leave a truthful review, express opinions and offer factual criticism remains unrestricted.

The Studio may take the measures provided for by law against demonstrably false statements of fact, insults, threats or other unlawful content.

§ 28 Right of Withdrawal and Online Bookings

Where contracts with consumers are concluded exclusively through means of distance communication, the statutory provisions on distance contracts and any applicable right of withdrawal apply.

Whether a right of withdrawal exists, is excluded or expires early in a particular case depends on the statutory requirements.

Cancelling an appointment does not automatically constitute the exercise of a statutory right of withdrawal.

§ 29 Data Protection

Personal data is processed in accordance with applicable data protection provisions. Further information is provided in the Studio’s Privacy Policy.

Health information contained in consent forms is processed only in accordance with the applicable data protection requirements.

§ 30 Final Provisions

The law of the Federal Republic of Germany applies, subject to mandatory consumer protection provisions.

Individual agreements with the customer take precedence over these Terms and Conditions.

If any provision of these Terms and Conditions is or becomes wholly or partly invalid, the legal consequences are governed by statutory provisions. The remaining provisions generally remain unaffected.
